Terms of Service

These terms are an agreement between you and Make Trending (“we”, “us”), which runs maketrending.com. By signing in or using the site you agree to them and to our Privacy Policy. If you don’t agree, please don’t use the site. Nothing in these terms limits rights you have under consumer laws that can’t be waived.

1. Who can use Make Trending

You must be 18 or older. You confirm this when you sign in. You need a Google account to sign in, and you’re responsible for activity on your account.

2. What we provide

You upload a photo, pick a trend, and we use AI video models to make a short video from it. Results vary, and a video may not look the way you expect. Videos are kept for 7 days so you can download them, then deleted. Please download any you want to keep. We may change, add or remove trends and features at any time.

3. Free videos, credits and payments

New accounts get free videos. Videos that fail don’t count against them. Paid packs aren’t on sale yet. When they launch, these rules apply, and the exact prices will be shown before you buy:

• Credits. One credit makes one video. Credits have no cash value, can’t be transferred, and can only be used on Make Trending.
• Packs are one-time purchases. Their credits expire 12 months after purchase.
• Monthly plans renew automatically. You’ll be charged the price shown when you subscribe at the start of each month until you cancel. Each month’s credits must be used that month and don’t roll over.
• Cancel any time from your Account page. Cancelling stops future charges; your plan and its credits last until the end of the month you’ve paid for. We don’t refund part-months.
• Price changes. If a plan’s price goes up, we’ll email you at least 30 days before your next renewal, so you can cancel first.
• Failed videos don’t use up credits: if a video fails, its credit is returned automatically.
• Refunds. If you haven’t used any credits from a pack, you can ask for a full refund within 14 days of buying it. We’ll also refund you if a technical problem on our side stops you from using what you paid for, and wherever the law requires. Otherwise, purchases are final. Email contact@maketrending.com for refunds.
• Payments are processed by Stripe. Prices include any taxes we’re required to collect unless shown otherwise.
• Ending your account. If you delete your account, unused credits are lost. If we close your account for breaking these terms, unused credits are lost. If we close the service, we’ll refund unused paid credits.

4. Your photos

You may only upload a photo if:

• it’s a photo of you, or everyone in it has given you permission;
• no one in it is under 18;
• it isn’t of a well-known person, and doesn’t contain nudity, sexual content, violence or hate symbols; and
• you have the right to use it.

You keep the rights you have in your photo. You give us permission to store and process it, and to send it to our service providers, to check it and make your video, and to keep it only as described in our Privacy Policy (for example, while a report about it is reviewed). We check photos automatically and may refuse any photo.

5. Your videos

We don’t claim ownership of the videos you make. You may download and share them for personal use, including on social media. Every video is AI-generated: don’t present it as real footage, and don’t use it to deceive, harass, impersonate or defame anyone.

6. Things you must not do

• Make a video of someone without their permission, or of anyone under 18.
• Make sexual, intimate or nude content of anyone.
• Use the site for anything illegal, or to infringe anyone’s rights.
• Try to get around our photo checks, limits or security, or use bots to access the site.
• Create extra accounts to get more free videos.

We may remove videos and suspend or close accounts that break these rules, and we may report illegal content to the authorities.

7. Reporting a video

If a video made with this site shows you without your permission, shows someone under 18, or breaks these rules, please report it. We review reports and remove videos that break the rules. Non-consensual intimate images are removed within 48 hours of a valid request.

8. Copyright complaints

If you believe something on the site infringes your copyright, email contact@maketrending.com with: your contact details, the work you own, where it appears on our site, a statement that you believe in good faith the use isn’t authorised, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for the owner, with your signature.

9. Deleting your account

You can delete your account at any time from your Account page. This deletes your photos and videos straight away and can’t be undone.

10. Our content

The site, its design, trend names and example videos belong to us or our licensors. The people in our example videos are AI-generated. Don’t copy or reuse them without our permission.

11. Disclaimers

The site is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will always be available, error-free, or produce any particular result, and we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement.

12. Limits on our liability

To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Our total liability for any claim about the site is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Some places don’t allow these limits, so they may not apply to you.

13. Indemnity

If someone makes a claim against us because of a photo you uploaded, a video you made or shared, or your breach of these terms, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.

14. Changes to these terms

We may update these terms. We’ll change the date above and, for significant changes, tell you on the site before they take effect. Using the site after that means you accept the new terms.

15. Ending these terms

You can stop using the site and delete your account at any time. We may suspend or close your account if you break these terms or if we have to for legal reasons, and we may stop offering the site. Sections 5 and 10 to 17 keep applying after these terms end.

16. Law and disputes

If you have a problem, please email contact@maketrending.com first and give us 30 days to try to sort it out. These terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Georgia, unless the law where you live gives you the right to bring it elsewhere.

17. General

These terms and the Privacy Policy are the whole agreement between you and us about the site. If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term straight away, we can still enforce it later. You can’t transfer these terms to anyone else; we may transfer them as part of a sale or reorganisation of our business, including to a company we form to run Make Trending.
